GTCs - General Terms and Conditions
In these General Terms and Conditions (hereinafter – GTC), the masculine form is used for simplicity.
The feminine and diverse forms are included.
1. Scope of the General Terms and Conditions
1.1 These General Terms and Conditions (“GTC”) shall apply to any use of the website of Miss Doginist, owned by Fabienne Christine Delavy (hereinafter the “Entrepreneur”), as well as to communication via email, WhatsApp or other communication channels, telephone calls, customer inquiries, and/or the provision of services.
1.2 By visiting or using the website, or by communicating with the Entrepreneur, the user or customer acknowledges that they have read these GTC and agrees to be bound by them in their entirety.
1.3 These GTC shall apply to all offers, courses, individual trainings, seminars, and events conducted by Miss Doginist.
2. Registration and Conclusion of Contract
2.1 Registration for all offers must be made in writing (via booking tool, email, online form, or WhatsApp) and shall be binding. By registering, the participant acknowledges and accepts these GTC.
2.2 For all courses other than online courses, the dog must be registered with AMICUS.
3. Cancellation
3.1 Private lessons, group lessons, home visits, and consultations (initial meeting) must be cancelled in writing at least 48 hours prior to the scheduled appointment. Otherwise, the full cost will be charged or deducted from the subscription package.
3.2 Events, seminars, and workshops must be cancelled at least 2 weeks prior to the start date. Otherwise, the full cost will be charged.
3.3 In the event of absence without prior cancellation, an administrative fee of CHF 50 will also be charged.
3.4 Cancellations for appointments scheduled on Mondays must be communicated no later than Friday evening (by 18:00 Swiss time). The same applies accordingly to recognized Swiss public holidays.
3.5 The Entrepreneur reserves the right to cancel lessons at short notice due to extraordinary circumstances, such as illness or accident on the part of the Entrepreneur. In such cases, no costs will be charged.
3.6 In the event of a delay by the customer, the originally scheduled time slot shall be observed. Missed time will not be made up.
4. Payment
4.1 No invoices will be issued. Course fees are to be paid in advance.
4.2 The price list forms part of these GTC and can be consulted on the website www.missdoginist.ch.
4.3 Prepaid packages or private sessions are non-refundable unless otherwise agreed with the Entrepreneur.
4.4 All prices are quoted in Swiss Francs (CHF).
5. Insurance and Disclaimer of Liability
5.1 Accident and liability insurance is the sole responsibility of the participants and/or dog owners.
5.2 During training, dog owners bear full responsibility and liability for themselves, their dog, and any accompanying persons. Dogs must be covered by liability insurance in accordance with statutory requirements. Compliance with this obligation is the responsibility of the dog owner.
5.3 In the event of theft, loss, or damage to a participant’s property during their stay at the training venue, the Entrepreneur shall only be liable in cases of intent or gross negligence.
5.4 The Entrepreneur assumes no liability for material, personal, and/or financial damages arising from the application of demonstrated exercises, nor for any damage or injury caused by participating dogs. Participants are liable for all damages caused by themselves and their dog. Any accompanying persons are deemed participants.
5.5 The Entrepreneur shall not be liable for injuries that may occur during free play among dogs.
5.6 The Entrepreneur provides no guarantee for the timeliness, accuracy, completeness, or quality of the information provided. Liability claims against the Entrepreneur relating to damages caused by the use or non-use of the provided information, or by the use of incorrect or incomplete information, are excluded. The Entrepreneur likewise assumes no liability for direct or indirect references to external websites.
5.7 The dog owner shall be liable, inter alia, for the following damages and for all resulting costs:
Damages to persons or property caused by their dog, despite the Entrepreneur’s due diligence and precautionary measures;
Illnesses of their dog and any resulting treatments;
Injuries sustained by their dog due to its own behavior;
Infections of other dogs resulting from the concealment or ignorance of a disease, or from ectoparasites introduced by their dog;
Unintended mating caused by a concealed heat in the female dog.
5.8 Should the dog in care cause damage, escape, or run away despite customary supervision, the dog owner shall be liable. Furthermore, the dog owner shall be liable for any damage or injury their dog causes to humans and/or other animals.
5.9 Items belonging to the dog owner, such as baskets, blankets, leashes, toys, etc., shall not be considered as deposited property. The Entrepreneur shall not be liable for any damage to such items.
5.10 Should a dog, despite all due diligence and precautionary measures, die, escape and not be recovered, or be stolen, the dog owner explicitly and fully waives any claim for compensation or damages.
5.12 In the event that the dog owner violates these GTC or disregards the instructions of the Entrepreneur, any liability of the Entrepreneur shall be excluded.
6. General Conditions and Rules of Conduct
6.1 The Entrepreneur undertakes to keep the dog in a species-appropriate and behavior-appropriate manner and to comply with the Animal Welfare Act as well as its supplementary provisions.
6.2 All dogs must be microchipped and in good health. Should the dog be ill or exhibit behavioral abnormalities, the owner is obliged to clearly inform the course instructor in advance. This also applies in cases where a female dog is in heat.
6.3 The dog owner warrants that their dog is healthy and free from contagious diseases.
6.4 On the parking area, in the premises, on the training ground, and on the surrounding grounds, dogs must be kept on a leash. Dogs may only be released upon the explicit instruction of the course instructor. Participants are required to clean up after their dogs. Smoking and the use of mobile phones are prohibited during lessons.
6.5 In cases of inappropriate or non-species-appropriate behavior, the Entrepreneur reserves the right to exclude the person from the course without issuing a course confirmation and without reimbursement of costs. Out of consideration for insecure dogs, no contact between leashed dogs is permitted without prior agreement. A minimum distance of 4 meters must always be maintained between all dog-handler teams.
6.6 In the event of a delay of more than 10 minutes, participation in the class or other event shall no longer be permitted.
6.7 The Entrepreneur reserves the right to change the training location for operational reasons if necessary. Any claims resulting from such a change of location are excluded.
6.8 The Entrepreneur reserves the right to cancel or postpone courses and lessons in the event of insufficient participant numbers or extraordinary circumstances. Any claims resulting from such cancellation are excluded.
6.9 Should a fight or scuffle occur between dogs, they will be separated and, in the event of injury, provided with veterinary care. If the instigator of the fight can be clearly identified, that owner shall bear all resulting costs. Otherwise, each dog owner shall bear the veterinary costs for their own dog.
6.10 The Entrepreneur reserves the right to apply a muzzle to a dog if necessary.
6.11 The Entrepreneur is authorized to take any other measures required to maintain operations, without prior consultation with the dog owner.
6.12 The dog owner is obliged to contribute to the maintenance of order in the operation of the Entrepreneur.
7. Intellectual Property
7.1 All film and photo recordings made during lessons may be used by the Entrepreneur for educational and/or publication purposes on the company’s website and other social media channels. Participants who do not agree to this must notify the Entrepreneur in writing no later than before the start of the course or service.
7.2 The dog owner agrees that the Entrepreneur may use photos of the dog, without naming the owner, in promotional materials, advertisements, and on social media.
7.3 All materials and documentation provided by the Entrepreneur are protected by copyright and may only be used for personal purposes. This also applies to content and images on the website. Any reproduction or distribution is permitted only with the express prior written consent of the Entrepreneur.
8. Disclaimers
8.1 The content and links available on the company’s website are provided for information purposes only and do not establish any legal relationship between the website visitor and the company. Any liability for damages arising from the use of the website or from information contained on the website is excluded. In particular, no liability is assumed for the timeliness, completeness, or accuracy of the content. Liability for links to third-party websites and their content is likewise excluded.
9. Severability of the General Terms and Conditions
9.1 The invalidity of any provision of these GTC shall not affect the validity of the remaining provisions.
9.2 Deviations from these General Terms and Conditions shall only be valid if agreed in writing.
10. Governing Law
10.1 These GTC shall be governed exclusively by Swiss law.
11. Place of Jurisdiction
11.1 The place of jurisdiction shall be the registered seat of the company.
